TOHONO O’ODHAM MAN SENTENCED TO SERVE TWELVE
AND A HALF YEARS FOR SEXUAL ABUSE AND DRUG
OFFENSES

TUCSON, Arizona – Alfred Vincent Havier, Jr., 68, a member of the Tohono O’odham Nation, was sentenced Feb. 2, 2009 to 63 months imprisonment for sexual abuse of a minor, by U.S. District Court Judge Frank R. Zapata. The sentence was ordered to run consecutively with the defendant’s sentence of 51 months imprisonment for possession with intent to distribute marijuana, which was imposed by U.S. District Court Judge Raner C. Collins on September 21, 2007, and a three year jail sentence in tribal court, for a total of twelve and a half years in custody.

The defendant repeatedly sexually abused the minor child victim over a period of several months, beginning when the victim was fourteen years old. The defendant initially denied his conduct, but DNA tests confirmed the victim’s statements that the defendant had sexually abused her. When law enforcement officers went to the defendant’s residence to arrest him, they found 892 kilograms of marijuana in the defendant’s shed. The defendant subsequently pleaded guilty to Possession With Intent to Distribute Marijuana on March 22, 2007, and to Sexual Abuse of a Minor on May 5, 2008.

The investigation leading to the conviction was conducted by the Federal Bureau of Investigation and the Tohono O’odham Police Department. The prosecution was handled by Angela W. Woolridge and Celeste Corlette, Assistant U.S. Attorneys, District of Arizona, Tucson.
