TUCSON, AZ—Denise Diane Philpott, 34, of Sierra Vista, Ariz., was sentenced yesterday by U.S. District Judge Marvin E. Aspen to five years in prison. Philpott pleaded guilty on October 24, 2008 to Transportation of Minors. Upon completion of the prison sentence, Philpott will be on supervised release for five years. During that time, she will participate in sex offender counseling and treatment, mental health treatment, and register as a sex offender. She must reside in a residence approved in advance by her probation officer. She is prohibited from having any contact with the victim, and any unsupervised contact with minors under age 18 without prior approval from her probation officer.

From 2004—2006, Philpott was employed as a behavior health technician at a group home for minor males. During that time, she engaged in sexual conduct with the victim, a resident of the home. On June 14th, the victim was reported missing and the investigation began. The investigation revealed that on June 14th, Philpott picked up the victim and left Arizona. On June 23, 2006, Philpott was located in the Midwest, along with the victim and Philpott’s children. The victim was taken into the custody by Child Protection Services and returned to Arizona. Philpott admitted she took the boy across state lines to engage in illicit sexual conduct and knew he was under 16 years of age. At that time, she was 31 years old.

The investigation in this case was conducted by the Federal Bureau of Investigation, Sierra Vista and Bloomington Indiana Offices and the Cochise County Sheriff’s Office. The prosecution was handled by Sandra M. Hansen, Assistant U.S. Attorney, District of Arizona, Tucson.
